Civil Liability, financial security and compensation claims for offshore oil and gas activities

Commission studies on Civil Liability, financial security and compensation claims for offshore oil and gas activities.

Pursuant to Art. 39 of Directive 2013/30/EU, the Commission is required to submit reports to the European Parliament and the Council on the availability of financial security instruments, handling of compensation claims and its assessment of effectiveness of the liability regimes. In this context, two studies have been conducted through external contracts:

  • A study on Civil Liability, financial security and compensation claims for offshore oil and gas activities, performed by the University of Maastricht, finalized on 22 October 2013, and

  • Offshore Safety: Commission publishes study on civil liability for offshore accidents. On the 14th of August 2014 the European Commission published a study on civil liability for offshore accidents in Europe. The study looks at how liability and compensation for bodily injury, property damage and economic loss are handled. It also addresses financial security instruments to cover such damage. The study is part of a Commission fact-finding exercise on the subject under the Offshore Safety Directive and not linked to any future legislative process.

Official Commission report on Liability, financial security and compensation claims for offshore oil and gas activities

The official report from the Commission to the European Parliament and the Council on liability, compensation and financial security for offshore oil and gas operations pursuant to Article 39 of Directive 2013/30/EU was published in September 2015.
